Terms of Service
Last updated: October 28, 2026
These terms govern your use of the Foylee website and services. By using them, you agree to these terms.
1. What Foylee does
Foylee provides an AI front desk for real estate agents, teams and brokerages ("Clients"). It answers inquiries from prospective buyers, sellers and renters ("Leads") by text message, asks qualifying questions, books appointments and sends follow-ups on the Client's behalf. Foylee is a software and services provider. It is not a real estate broker, does not give legal, financial or lending advice, and does not represent any party in a transaction.
2. SMS messaging terms
Program: Foylee lead response and appointment messages, sent on behalf of the real estate professional you contacted, and Foylee demo messages.
What you will receive: replies to your inquiry, qualifying questions, appointment confirmations and reminders, and follow-ups about the property or service you asked about.
How you opt in: by checking a consent box on a form, or by texting first. Consent is not a condition of any purchase.
Frequency: message frequency varies based on your conversation.
Costs: message and data rates may apply.
Opt out: reply STOP at any time. You will receive one confirmation and no further messages. You can also reply CANCEL, END, QUIT or UNSUBSCRIBE.
Help: reply HELP or email hello@foylee.com.
Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your information.
3. Client responsibilities
Clients who use Foylee agree to:
- Have a lawful basis and documented consent before Foylee contacts any Lead, and provide accurate Lead information.
- Comply with all applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM, state telemarketing and real estate licensing laws, and the Fair Housing Act.
- Review and approve the scripts, questions and information Foylee uses on their behalf, and keep that information accurate.
- Not use Foylee to send unsolicited marketing, purchased lists, or prohibited content.
4. Accounts, fees and payment
Services, setup fees and monthly fees are described in each Client's order or service agreement. Messaging and carrier fees are passed through at cost unless agreed otherwise. If a signed service agreement conflicts with these terms, the service agreement controls.
5. Acceptable use
You may not misuse the service, including by trying to access it without authorization, interfering with its operation, reverse-engineering it, or using it for anything unlawful, deceptive or harassing.
6. AI-generated responses
Foylee uses artificial intelligence to write messages. We design it to be accurate and to hand conversations to a human when needed, but responses may sometimes contain errors. Important details such as prices, availability and terms should be confirmed with the real estate professional.
7. Intellectual property
Foylee, its logo, software and content belong to us. Clients keep ownership of their own data and Lead information.
8. Disclaimers and limitation of liability
The service is provided "as is" and "as available." To the maximum extent allowed by law, Foylee disclaims all implied warranties and is not liable for indirect, incidental, special or consequential damages, or lost profits or deals. Our total liability for any claim is limited to the fees the Client paid us in the three months before the claim.
9. Termination
You can stop using the service at any time. We may suspend or end access if these terms are violated or if needed to comply with law or carrier requirements.
10. Changes
We may update these terms. We will post the new version on this page and change the date at the top. Continued use means you accept the updated terms.
